1. Introduction and Parties

1.1. These Terms and Conditions ("Terms") govern your use of the website, newsletter, paid membership, members' community, and related digital content provided by Sing Yourself Happy at singyourselfhappy.com ("the Website", "the Publication", "the Service").

1.2. The Service is operated by David Alston, a sole trader registered in England and Wales, trading as Sing Yourself Happy, with a principal business address at Halton Mill, Mill Lane, Halton, Lancaster, LA2 6ND ("we", "us", "our", "the Trader").

1.3. The Website is hosted on Bunny.net. We use Birdsend to manage our email list and send emails, Stripe to process payments, and Signal to run our private members' community. Your use of those services may also be governed by their own terms and policies.

1.4. By accessing the Service, subscribing to the Publication, becoming a paid member, joining the members' community, submitting material, or otherwise using the Service, you ("the Reader", "the Member", "you", "your") agree to be bound by these Terms. If you do not agree, you must not use the Service.

1.5. We reserve the right to amend these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Business Information (Electronic Commerce (EC Directive) Regulations 2002)

3. Description of the Service

3.1. Sing Yourself Happy is a Christian newsletter, publication, and founding membership for people who want to stay informed without fear, sing themselves happy, use AI wisely for good, and share their gifts in a changing world.

3.2. The free Service consists of The Saturday Brief and related emails. The paid membership may include members' emails, audio or video material, community prompts, Song / Psalm / Hymn / Poetry Drops, practical AI-for-good prompts, access to our private members' community on Signal, and access to related benefits such as Only One You Pro Bio Pages where offered.

3.3. The Service is provided as digital content and/or a digital service within the meaning of the Consumer Rights Act 2015.

3.4. The newsletter is delivered by email. You will need an internet-connected device, a valid email address, and — to take part in the members' community — the Signal app. There is no login or account to manage on this Website; your free or paid status is managed through your email subscription and, for members, your place in the private Signal community.

3.5. We may modify, add, pause, or discontinue features of the Service from time to time. The launch membership is a founding offer and may evolve as the community develops. We will not deliberately remove the core paid membership benefit you have paid for during your current billing period without a reasonable substitute or remedy.

4. Eligibility

4.1. You must be at least 18 years old to purchase a paid subscription or enter into a contract with us.

4.2. By entering into a contract with us, you confirm that you have the legal capacity to do so.

4.3. The Service is written primarily for adults. It is not directed at children.

5. The Email List and Membership Access

5.1. The free newsletter and members' emails are delivered through Birdsend. You are responsible for maintaining access to the email address you subscribe with.

5.2. Paid membership gives you access to members' emails and an invitation to our private members' community on Signal. Signal allows you to set a username, so you can join and take part without sharing your phone number with us or with other members.

5.3. New members of the Signal community may be admitted by approval, so that membership corresponds with active paid subscriptions. We may decline or remove access where a subscription is not active or where these Terms are breached.

5.4. We are not responsible for outages, account issues, or technical failures caused by Bunny.net, Birdsend, Stripe, Signal, your email provider, your device, your internet connection, or other third-party services beyond our reasonable control.

6. Subscription Plans and Pricing

6.1. Paid membership is offered on a subscription basis. Launch pricing may include a founding member annual offer.

6.2. The expected launch offer is:

6.3. Future standard pricing is expected to be GBP47.00 per year. Where a founding rate is offered and stated at the point of purchase, founding members keep that rate while their paid subscription remains active, subject to Stripe continuing to support the subscription.

6.4. Prices are clearly shown before you confirm your purchase. All prices are inclusive of VAT where applicable. We are not currently VAT registered.

6.5. We may change pricing for new subscribers at any time. Existing subscribers will receive notice of any change affecting their renewal price where required by law.

7. Payment Terms

7.1. Payments are processed through Stripe. We do not store your full card details.

7.2. By subscribing, you authorise recurring charges to your chosen payment method at the interval shown at checkout.

7.3. Your subscription will automatically renew unless cancelled in accordance with Clause 9, using the Stripe customer portal or by contacting us.

7.4. If a payment fails, Stripe may retry the payment or notify you, and we may suspend access to paid benefits and the members' community until the outstanding amount is settled.

7.5. Stripe may apply its own terms, security checks, fraud prevention measures, and payment processing rules.

8. Consumer Rights: Right to Cancel

8.1. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer based in the UK or EU, you may have a statutory right to cancel within 14 days of entering into the contract, without giving any reason.

8.2. Because the Service provides immediate access to digital content and digital services, you may be asked at the point of purchase to:

(a) give express consent for the Service to begin before the 14-day cancellation period expires; and

(b) acknowledge that you may lose the statutory right to cancel once the digital content or service has begun or been fully performed.

8.3. If you wish to exercise a statutory cancellation right, please contact us at help@singyourselfhappy.com as soon as possible.

8.4. You may use the model cancellation form below, but it is not obligatory:

9. Cancellation of Subscription

9.1. You may cancel your subscription at any time using the Stripe customer portal (linked from your payment receipts), or by contacting help@singyourselfhappy.com.

9.2. Upon cancellation:

(a) your access to paid emails and the members' community will normally continue until the end of your current paid billing period, after which your place in the community may be removed;

(b) no further charges should be applied after the current billing period, provided cancellation is completed before renewal;

(c) we do not generally provide a pro-rata refund for unused time remaining in the current billing period, except where required by law or where we approve a goodwill refund.

9.3. We are committed to making cancellation straightforward, in line with current UK consumer expectations and the subscription rules under the Digital Markets, Competition and Consumers Act 2024.

10. Refunds

10.1. Refund requests are handled in good faith and subject to the practical controls available through Stripe.

10.2. If you believe you have been charged in error, please contact help@singyourselfhappy.com promptly with the email address connected to your subscription and the approximate date of payment.

10.3. Where a refund is approved, it will usually be returned to the original payment method through Stripe. Bank and card processing times may vary.

10.4. Nothing in these Terms affects your statutory rights as a consumer.

11. Digital Content and Service Quality

11.1. Under the Consumer Rights Act 2015, digital content and digital services supplied to consumers must be of satisfactory quality, fit for purpose where that purpose has been made known, and match their description.

11.2. If the Service does not meet the required standard, you may be entitled to remedies under the Consumer Rights Act 2015, including repair, replacement, or an appropriate price reduction.

11.3. Sing Yourself Happy is a developing publication and founding membership. We do not guarantee a fixed number of posts, songs, prompts, events, or community interactions unless explicitly promised at the point of purchase.

12. Acceptable Use and Community Conduct

12.1. Subject to your compliance with these Terms, you may access and use the Service for your own personal, non-commercial purposes.

12.2. You must not use the Service or the members' community to:

(a) publish unlawful, defamatory, obscene, hateful, abusive, discriminatory, threatening, harassing, or deliberately divisive material;

(b) infringe another person's copyright, trade mark, privacy, publicity, or other rights;

(c) distribute spam, malware, phishing links, scams, or misleading promotions;

(d) impersonate another person or misrepresent your identity or affiliation;

(e) copy or redistribute paid content or members' material without permission;

(f) disrupt the Service, the Signal community, or the experience of other members.

12.3. We may moderate, hide, remove, or report material that breaches these Terms, and may remove members from the community for breach.

12.4. We may suspend or end access to the community where a member repeatedly or seriously breaches these Terms. Where a paid subscription is affected, we will act reasonably and in line with consumer rights.

13. Member Submissions, Songs, Audio, and Creative Work

13.1. From time to time, members may share voice notes, songs, psalms, hymns, poems, testimonies, project notes, or other creative material ("Member Content"), including in the members' community.

13.2. You retain ownership of the Member Content you submit.

13.3. By submitting Member Content, you confirm that you have the right to share it and that it does not infringe the rights of any third party.

13.4. If you give us permission to feature, quote, publish, play, summarise, or otherwise share your Member Content, you grant us a non-exclusive, royalty-free licence to use that material for the purpose agreed, including within Sing Yourself Happy emails, audio/video material, member updates, or related promotion of the Publication.

13.5. We will not deliberately publish a private voice note, song recording, personal testimony, or similarly personal submission as a featured item outside the community without your permission.

13.6. You may ask us to stop using your Member Content in future material by emailing help@singyourselfhappy.com. We will act reasonably, but we may not be able to remove material from emails already sent, from backups, or from content already shared with or seen by other members in the community.

14. Intellectual Property

14.1. All intellectual property rights in the Service, including text, branding, logos, design, original posts, audio/video material, prompts, frameworks, and other content created by us, are owned by or licensed to David Alston unless otherwise stated.

14.2. Paid content is supplied for your personal use as a subscriber or member. You must not copy, republish, sell, sublicense, upload, or distribute paid content without our prior written consent.

14.3. Brief quotations for ordinary discussion, review, or fair dealing purposes are permitted where lawful and properly attributed.

14.4. Sing Yourself Happy may reference Scripture, hymns, public-domain works, third-party reporting, tools, services, or other external material. Rights in third-party material remain with their respective owners.

15. Only One You Access

15.1. Paid membership may include access to Only One You Pro Bio Pages as a related benefit.

15.2. Only One You is operated by David Alston at onlyone.you and has its own Terms and Conditions, Privacy Policy, Cookie Policy, and Refund Policy.

15.3. If you activate or use Only One You, the legal documents at onlyone.you apply to your use of that service.

15.4. If the Only One You benefit changes, pauses, or becomes unavailable, we will act reasonably and may offer a substitute benefit, remedy, or explanation depending on the circumstances and your statutory rights.

16. No Professional Advice

16.1. Content published by Sing Yourself Happy is for general information, reflection, commentary, encouragement, and community purposes only.

16.2. Nothing in the Service constitutes legal, financial, tax, medical, investment, mental health, theological, pastoral, or other professional advice.

16.3. You should seek appropriate independent advice before making important decisions based on anything you read, hear, or discuss through the Service.

17. External Links and Third-Party Services

17.1. The Service may include links to third-party websites, services, articles, videos, books, tools, or resources.

17.2. We are not responsible for the content, policies, availability, accuracy, or security of third-party websites or services.

17.3. The inclusion of a link does not imply endorsement unless clearly stated.

18. Limitation of Liability

18.1. Nothing in these Terms limits or excludes our liability for:

(a) death or personal injury caused by our negligence;

(b) fraud or fraudulent misrepresentation;

(c) any liability which cannot be excluded or limited under applicable law, including consumer statutory rights.

18.2. Subject to Clause 18.1, our total liability to you in connection with the Service shall not exceed the total amount you have paid us in the 12 months preceding the event giving rise to the claim.

18.3. Subject to Clause 18.1, we shall not be liable for any indirect or consequential loss, loss of profits, loss of business, loss of opportunity, loss of data, or loss arising from your reliance on general information published through the Service.

18.4. The Service is provided on an "as available" basis. We do not guarantee uninterrupted or error-free access.

19. Indemnity

19.1. You agree to indemnify and hold harmless David Alston, trading as Sing Yourself Happy, from and against any claims, damages, losses, liabilities, or expenses arising out of your breach of these Terms, misuse of the Service, or Member Content you submit, except to the extent such liability cannot lawfully be passed to you as a consumer.

20. Force Majeure

20.1. We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, government action, internet or infrastructure failures, email delivery issues, payment processor issues, platform outages, or third-party service provider failures.

21. Dispute Resolution

21.1. If you have a complaint or dispute, please contact us first at help@singyourselfhappy.com. We will endeavour to resolve the matter informally.

21.2. If we cannot resolve the dispute informally, UK consumers may refer the matter to an approved Alternative Dispute Resolution (ADR) provider. Further information is available from the UK Government: https://www.gov.uk/consumer-disputes.

21.3. EU consumers may also submit a complaint via the EU Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr.

22. Governing Law and Jurisdiction

22.1. These Terms are governed by and construed in accordance with the laws of England and Wales.

22.2. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

22.3. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of your country of residence. If you are a consumer in the EU, you retain the benefit of any mandatory consumer protection provisions of your country of residence.

22.4. For US-based customers: These Terms are governed by English law. However, nothing in these Terms affects any non-waivable statutory rights you may have under the laws of your US state of residence.

23. Severability

23.1. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.

24. Entire Agreement

24.1. These Terms, together with our Privacy Policy and any purchase information shown at checkout, constitute the entire agreement between you and us in respect of the Service.

24.2. Stripe's payment terms, Birdsend's terms, Signal's terms, and any applicable platform terms may also apply to your use of their respective services.

25. Related Services

25.2. Those services have their own legal documents. If you use those services, their respective terms and policies apply.
